Probate Attorney in Bountiful, Utah
Flat-fee probate representation for Bountiful families. Informal probate, formal probate, and small estate affidavits — handled from our office just across the city line.
When a loved one passes away, the last thing any Bountiful family wants to deal with is a complicated legal process. Probate in Davis County is usually more straightforward than people expect — but only when it's handled by someone who works in this county every week.
Our office is located at 1010 North 500 East, Suite 200 in North Salt Lake, directly on the Bountiful boundary. For most Bountiful residents, we're less than a five-minute drive — a short trip down 500 East, 400 North, or straight off Interstate 15 Exit 315. We serve families from the Bountiful bench, downtown Main Street, and the newer neighborhoods along the west side of the city.
How we help Bountiful families with probate
Most Bountiful probate cases we handle fall into one of three categories:
- Informal probate — the standard uncontested process when a valid will exists or when all heirs agree on how to administer the estate. This is the most common path, and for a typical Bountiful estate it moves through the Davis County Second District Court in a predictable timeline.
- Formal probate — used when a will is contested, when creditors need to be formally barred, or when the family needs a court-supervised resolution to a dispute.
- Small estate administration — for estates where the total personal property is under the Utah statutory threshold of $100,000, we can often avoid probate entirely using a small estate affidavit under Utah Code § 75-3-1201.
We also handle ancillary probate when a Bountiful resident owns property in Arizona or another state, and intestate estate administration when someone passes without a will.
The Davis County Second District Court
All Davis County probate cases — including those for Bountiful residents — are filed with the Second District Court at 800 West State Street in Farmington, the county seat. The drive from Bountiful to the courthouse is roughly 15 minutes up I-15. For most informal probate matters, the personal representative is not required to appear in person — we handle the filings, notices, and documentation from our office.
The probate timeline for Bountiful estates
For an uncontested Bountiful estate with clear title and no disputes, the typical timeline is:
- Week 1–2: File the Application for Informal Probate; the court issues Letters Testamentary (or Letters of Administration if there is no will), which give the personal representative legal authority to act.
- Weeks 2–6: Publish the Notice to Creditors. Utah requires publication in the Intermountain Commercial Record, a statewide legal newspaper. Known creditors also receive direct notice.
- Months 2–5: The three-month creditor claim period runs. During this time, the personal representative inventories assets, pays valid claims, and handles the estate's accounts.
- Months 5–6: Close the estate by distributing remaining assets to beneficiaries and filing the closing documents with the court.
Most uncontested Bountiful probate cases wrap up in four to six months. Contested cases, estates with real property in multiple counties, or estates with significant tax issues take longer.
